1. Scope
These Terms and Conditions apply to the use of the ECU Jobs online platform.
ECU Jobs is a brokerage platform on which customers can find professional ECU programmers (hereinafter referred to as “Tuners”) for services in the field of engine control unit programming.
By registering for or using the platform, users accept these Terms and Conditions.
2. Operator
The operator of the platform is the provider named in the Legal Notice.
3. Platform Services
ECU Jobs exclusively provides a technical platform for brokering jobs between customers and tuners.
The platform particularly includes:
- publication of jobs
- brokerage of suitable tuners
- offer management
- release of contact details after offer acceptance
- management of user accounts
- premium features for tuners
ECU Jobs is not a contractual party to service contracts concluded between customers and tuners.
4. Registration
Registration is required for certain functions.
The user undertakes to:
- provide truthful information,
- keep access credentials confidential,
- not use third-party accounts.
Multiple registrations for the purpose of circumventing restrictions are not permitted.
5. User Accounts
The operator may suspend or delete user accounts, particularly if:
- false information is provided,
- these Terms and Conditions are violated,
- misuse occurs,
- security risks arise.
6. Services Provided by Tuners
Tuners act on their own responsibility.
They are solely responsible for:
- their services,
- their prices,
- their offers,
- their communication,
- their invoicing,
- tax obligations,
- legal requirements in their country.
7. Customer Obligations
Customers undertake to:
- describe jobs truthfully,
- not upload unlawful content,
- only upload files they are authorized to use,
- not misuse the platform.
8. Conclusion of Contracts
A contract for programming or tuning services is concluded exclusively between the customer and the tuner.
ECU Jobs does not become a contractual party.
9. Premium Membership
Paid premium memberships may be offered for tuners.
Premium features may particularly include:
- unlimited offer submissions
- preferred visibility
- additional premium features
The type and scope of premium features are determined by the current service description.
10. Payments
Payment processing is handled through Stripe.
The Stripe terms of use also apply.
ECU Jobs does not store complete payment data.
11. Term and Termination
Premium memberships renew automatically according to the selected billing period unless they are cancelled in due time via the Stripe customer portal or in accordance with the applicable terms.
After expiry, premium access ends according to the paid period.
12. Verification
ECU Jobs may verify tuners.
Verification does not constitute a guarantee for the quality of the services offered.
The operator reserves the right to:
- reject verifications,
- revoke verifications,
- request verification again.
13. Reviews
If review functions are offered, reviews must be objective and truthful.
Insulting, false or unlawful content is not permitted.
14. Permitted Use
The following are particularly prohibited:
- spam
- automated registration
- bot usage
- circumvention of security measures
- malware
- attacks on the platform
- unlawful content
- copyright infringements
15. Liability
ECU Jobs is liable exclusively to the extent provided by law.
In particular, ECU Jobs assumes no liability for:
- the quality of services provided by tuners
- economic losses arising from brokerage
- incorrect programming
- vehicle damage
- engine damage
- transmission damage
- consequential damage
- data loss
- loss of profit
Responsibility for performing the commissioned services lies exclusively with the respective tuner.
16. Availability
The operator strives to provide the highest possible availability.
There is no entitlement to uninterrupted accessibility.
Maintenance, updates or technical disruptions may lead to restrictions.
17. Intellectual Property
All platform content, particularly logos, texts, designs and software components, is protected by copyright.
Use outside the platform requires the prior consent of the operator.
18. Data Protection
The separate Privacy Policy of the platform applies.
19. Changes to the Terms and Conditions
The operator may amend these Terms and Conditions for objective reasons.
Registered users will be informed about material changes.
20. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, to the extent permitted by law.
If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions remains unaffected.
